1. Acceptance of Terms

By accessing or using the VideocreationAI platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and VideocreationAI ("we," "us," or "our"). Your continued use of the Service following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

VideocreationAI is an AI-powered video creation platform that enables users to generate, edit, and publish videos using artificial intelligence tools. The Service includes features such as automated video generation, text-to-speech synthesis, script writing assistance, background music integration, YouTube publishing, and related capabilities. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. User Accounts

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period. You may not create multiple accounts to circumvent restrictions or limitations imposed on your account.

4. Credits & Subscriptions

The Service operates on a credit-based system. Credits are consumed when you use AI-powered features such as video generation, voice synthesis, and image creation. Credits are non-transferable and have no cash value.

4.1 Free Trial

We may offer a free trial period for new users. Trial credits are limited and subject to change without notice. Trial accounts may have restricted access to certain premium features.

4.2 Paid Subscriptions & Cancellation

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated herein. If you subscribe to a paid plan, you may cancel your subscription within 3 days of the initial charge to receive a full refund — no questions asked. After this 3-day cancellation window, no refunds will be issued for the current billing period. Your subscription will remain active until the end of the paid period. We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

4.3 Credit Purchases & Expiry

One-time credit purchases are final and non-refundable. All credits — whether granted through a subscription plan or purchased as a one-time top-up — expire 30 days after the date they are credited to your account. Credits do not roll over, accumulate, or stack from one period to the next: each new grant of credits replaces, and does not add to, any unused credits from a prior period. Expired credits are forfeited and have no cash value. We are not responsible for credits lost due to expiry, or due to account termination resulting from violations of these Terms.

5. Intellectual Property

Your Content: Any content you upload to the Service (scripts, images, audio files, etc.) remains your property. You grant us a limited license to process and store your content solely for the purpose of providing the Service.

AI-Generated Content: All videos, images, audio, and other output generated by the AI tools within the Service are owned by you, the user who created them, subject to any restrictions imposed by underlying AI providers. You may use AI-generated content for personal or commercial purposes without restriction from VideocreationAI. We make no claim of ownership over your generated content.

Our Platform: The VideocreationAI platform, including its design, software, trademarks, logos, and underlying technology, is the exclusive property of VideocreationAI and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works of our platform without our express written consent.

6. Prohibited Uses

You agree not to use the Service to:

Create content that is defamatory, obscene, pornographic, harassing, threatening, or otherwise unlawful
Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
Spread misinformation, disinformation, or deliberately deceptive content
Generate deepfakes or synthetic media intended to deceive or harm individuals
Conduct automated scraping, crawling, or data mining of the Service
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Circumvent, disable, or interfere with security features of the Service
Use the Service for any illegal purpose or in violation of any applicable law or regulation
Resell or commercially exploit access to the Service without our prior written consent
Impersonate any person or entity or misrepresent your affiliation with any person or entity

Violation of these prohibitions may result in immediate termination of your account and potential legal action.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIDEOCREATIONAI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT GENERATED BY OR THROUGH THE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIDEOCREATIONAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

9. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Termination does not entitle you to a refund of any unused credits or subscription fees outside the 3-day cancellation window described in Section 4. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 7, 8, and 11.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending you an email notification. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of your rights and obligations.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
